Young Change Agents [Young Change Agents] (“Young Change Agents,” “we,” or “us”) owns and operates the website located at https://youngchangeagents.com/ (“Website”), the Platforms located at https://app.youngchangeagents.com/ (“Platform”) which provides entrepreneurial learning for educators and youth and any other services provided via the Website, Platform or by Young Change Agents to you (“ all together, the Services”).

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using or accessing the Website, Platform and/or Services, as these Terms and Conditions will apply to all educators, users and anyone who accesses Website, Platform and/or Services (“you”, “yours”).

Young Change Agents is an Australian not-for-profit social enterprise that exists to help youth think of problems as opportunities and make a positive change in the world through enterprise. The intention of our Services is to help amplify the voices of young people and support educators to deliver entrepreneurial programs for youth.

Educators are supported in teaching entrepreneurial learning through access to online learning resources and digital materials, technology that supports the delivery of programs with youth and youth amplification of ideas, and online events and forums to connect with other educators through a community of practice.

1.0 Terms and Conditions Educators
Your access to and use of Young Change Agents Website, Services and Technology is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service as part of a Youth Design Challenge you agree to be bound by these Terms, as updated by us from time to time. You should check this page regularly to take notice of any changes we may have made to the Terms and Conditions.

2.0 Terms and Conditions
By accessing or using Young Change Agents Services you agree to be bound by these general Terms regarding all aspects mentioned above.

You acknowledge that we retain exclusive ownership and control of the intellectual property rights in all software, design, materials and content (including photographic images) made available to you on or through the Website, Services or Platform.

2.1 Access
Our Services are intended for use by educators, schools, parents and guardians, and young people participating in educational and entrepreneurial learning programs. Educators, schools, parents and guardians may create and manage their own accounts.

If your school or organisation provides access to users under the age of 18, you are responsible for ensuring that any parental or guardian consents required under applicable laws or your organisation's policies have been obtained before access is provided.

Children under the age of 13 must not create their own account. Where a child under 13 requires access to features of the Services that require an account (for example, posting a project, entering an award or competition, or sharing a portfolio), the account must be created and managed by a parent, legal guardian, or an authorised educator or school using an appropriate email address.

If you are accepting these Terms on behalf of another legal entity, including a business or a government, you represent that you have full legal authority to bind such entity to these terms.

You may browse the Site and view Content without registering, but as a condition to using certain aspects of the Site, you may be required to register with us and select a password and screen name (“User ID”).

You shall provide us with accurate, complete, and updated registration information. Failure to do so shall constitute a breach of the Terms and Conditions of Use, which may result in immediate termination of your account. You shall not
(i) select or use as a User ID or domain a name of another person with the intent to impersonate that person;
(ii) use as a User ID or domain a name subject to any rights of a person other than you without appropriate authorisation; or
(iii) use as a User ID or domain a name that is otherwise offensive, vulgar or obscene.

We reserve the right to refuse registration of, or cancel a User ID and domain in our sole discretion. You are solely responsible for activity that occurs on your account and shall be responsible for maintaining the confidentiality of your password. You shall never use another user’s account without such other user’s express permission. You will immediately notify us in writing of any unauthorised use of your account, or other account related security breach of which you are aware.

2.2 Services
Access to the Services is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason the Services are unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of the Services.

We may, at any time, enhance and/or alter the features of the Services at our sole discretion and without notice to you.

We reserve the right to monitor your use of the Services, through cookies and other means, for the purpose of obtaining insights about how users use the Platform and ensuring you are complying with these Terms and Conditions.

Young Change Agents grants you a personal, non-transferable, non-exclusive, revocable, limited license to use and access the Services solely as permitted by these Terms. We reserve all rights not expressly granted to you by these Terms.

You are solely responsible for the information associated with Your Account and anything that happens related to Your Account. You must maintain the security of your Account and promptly notify us if you discover or suspect that someone has accessed your Account without your permission. We recommend that you use a strong password that is used only with the Services.

You will not license, sell, or transfer your Account without our prior written approval.

All personal information you give us will be dealt with in a confidential manner in accordance with our Privacy Policy. By submitting Your Content to the Services, you represent and warrant that you have all rights, power, and authority necessary to grant the rights to Your Content contained within these Terms. Because you alone are responsible for Your Content, you may expose yourself to liability if you post or share Content without all necessary rights.

You retain any ownership rights you have in Your Content, but you grant Young Change Agents the following license to use that Content:

When Your Content is created with or submitted to the Services, you grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable, and sublicensable license to use, copy, modify, adapt, prepare derivative works from, distribute, perform, and display Your Content and any name, username, voice, or likeness provided in connection with Your Content in all media formats and channels now known or later developed. If we make material changes to these Terms, we will take reasonable steps to notify affected users, schools or organisations where appropriate before or when the updated Terms take effect.

Your continued use of the Services after the updated Terms become effective constitutes acceptance of the revised Terms.

2.7 Conduct
In your digital interactions with other users (including but not limited to: comments on projects), you agree to conduct yourself civilly and respectfully. While using the Services, you agree that you shall not under any circumstances harass or make mischief against any other user of the Services. Young Change Agents reserves the right to determine, at its sole discretion, what constitutes harassment or mischief, and where that has occurred; and may, also at its sole discretion, partially or completely deny service to any infringing party. As part of these efforts, Young Change Agents may enlist the help of its active users to moderate flagged messages, comments and other content to determine if a user’s conduct is harmful to the community.

You must use this Services only for lawful purposes and in a manner that does not infringe the rights of or restrict or inhibit the use and enjoyment of this Services by any third party. This includes conduct which is unlawful or which may harass or cause distress or inconvenience to any person, the transmission of obscene or offensive content or disruption to this Services. You must not post or transmit via this Services any unlawful, defamatory, obscene, offensive or scandalous material, or any material that constitutes or encourages conduct that would contravene any law.

Young Change Agents is not responsible for the copyright or trade marking of a team idea and/or project. It is the responsibility of the individual to understand the impact of sharing their ideas on our Services. Young Change Agents is not responsible for the loss of intellectual property caused by the user sharing their idea or a user sharing an idea of a third party. We encourage our users to think carefully before sharing on our Platform and when accessing our Services. We take no responsibility for the copyright of an idea and advise our users to take the appropriate legal action, if they feel necessary, before publicly displaying an idea that they want to protect the intellectual property of.

2.9 Liability
To the extent permitted by law we exclude all other terms, conditions, warranties and guarantees which might be implied into these Terms and Conditions. Subject to any non-excludable consumer guarantees and other consumer protection provisions set out in the Australian Consumer Law, the material displayed on the is provided without any guarantees, conditions or warranties as to its accuracy. Terms, conditions and warranties implied by law which cannot be excluded, restricted or modified apply to these Terms of Use to the extent required by Law.

Subject to this clause 2.9, our total and aggregate liability for loss suffered or sustained by you in connection with the provision of the Services whether arising as a result of breach of contract, in tort (including negligence) under statute or common law and/or whether or not arising pursuant to an indemnity in these Terms and Conditions, will be limited to the fees paid by you (if any) for the Services or $1, whichever is higher.

Young Change Agents is an Australian not-for-profit social enterprise that exists to help youth think of problems as opportunities and make a positive change in the world through enterprise. The intention of our Website, Services and Technology is to help amplifying the voices of young people and support educators to deliver entrepreneurial programs for youth. Young people can amplify their voice by helping build the profile of their initiatives and support them to gain connections and look for funding or other support needed!

Young Change Agents Website, Services and Technology help young people amplify their voices and ideas by allowing youth to create project pages, build portfolios and enter awards and competitions (This may include Design Challenges, Entrepreneurial Learning Hub, Portfolio, Project Pages).

Your access to and use of the Young Change Agents Website, Services and Technology is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

1.1 National Youth Design Challenges
Project ideas will only be accepted between the closing dates identified on the challenge page and the main proponent of the idea must be between 10-21 years by the date the challenge starts.

All entries agree to their videos and photos being used for the purposes of education and inspiring other young people to participate in design thinking/entrepreneurial education.

Projects may be selected to be featured on the website each week.

The winning ideas will be chosen by the judging panel (refer to the Challenge Page for details of the Judges) and the judges decision is final.

All winning ideas will be published on the Young Change Agents website and may be viewed by the general public. Entrants are able to edit and update this page up until the challenge closes.

Young Change Agents reserves the right to edit any spelling or grammatical errors and adjust images if required to maintain the quality standards on our site.

The ideas posted by youth are the intellectual property of the young person. Young Change Agents holds no responsibility for the protection of the intellectual property. If your idea involves an invention that you intend to develop further you may wish to consider protection for your idea. See IP Australia for more information on what can/can't be protected.

1.2 $20 Boss Awards
Project ideas will only be accepted between the closing dates identified on the awards page and for the specified time period identified on the awards page when the proponent or group completed $20 Boss at their school.

All entries agree to their videos and photos being used for the purposes of education and inspiring other young people to participate in design thinking/entrepreneurial education.

Projects may be selected to be featured on the website each week.

1.3 School Based Youth Workshops
Project ideas may be featured on Young Change Agents website and within post program reports from School Based Youth Workshops.

All participants that provide consent agree to their videos and photos being used for the purposes of education and inspiring other young people to participate in design thinking/entrepreneurial education.

Projects may be selected to be featured on the website each week and may be viewed by the general public. Project pages are able to be edited and updated with the login details provided.

Young Change Agents reserves the right to edit any spelling or grammatical errors and adjust images if required to maintain the quality standards on our site.
